Terms and Conditions

1. User agreement

This website (under domain names acecis.com.au and acecis.com) is owned and operated by ACECIS?- the Australian Careers and Employment Centre for International Students (ABN 7822 0866 806).

By using the ACECIS website and associated social media pages, you accept the terms and conditions?and our privacy policy. This user agreement is between you and ACECIS (referred to in this?agreement as ‘we’, ‘us’ or ‘our’.

These terms and conditions can be changed at any time. Any such changes will be updated on the?website and will be effective immediately. By using the ACECIS website, you agree to be bound by?these terms and conditions and any subsequent changes.

By using the ACECIS website, you grant your express consent to us to send you direct marketing?material to the email address you provide. You can unsubscribe at any time.

2. Access and use of the ACECIS website

2.1 You must use the ACECIS website in accordance with these terms and conditions. You must?not or attempt to interfere (or attempt to interfere) with the ACECIS website or associated sites,?pages, data or security features. You must not interfere (or attempt to interfere) with the servers or?networks that host this site.

2.2 As an ACECIS member, you must keep your log in details and password secure and private. We?take no responsibility or liability for any unauthorised activity on your account or portal.

2.3 You must not use another ACECIS member’s account unless you have written permission from?ACECIS and the other user. If you believe that another person has gained access to your account?and access has been breached, you must notify ACECIS immediately. You must also take appropriate?action to change your log in details.

2.4 We make no promises or warrant that the ACECIS website will be available all day and at all?times. There may be disruptions to the website from time to time which we will repair and correct?as soon as possible. We make no promises or warrant that other websites and content that link from?the ACECIS website will be free from disruption.

3. Liability

3.1 ACECIS does not warrant, guarantee, endorse or take any responsibility for any product or?service advertised, offered or delivered by a third party (including payment gateway providers). We?take no responsibility for any transaction between you and a third party.

3.2 ACECIS will in no way be liable for any direct, indirect, incidental, special or consequential?damages, resulting from your use or inability to use the ACECIS website, social media sites or other?related sites or for the cost of substituting any products or services. We are not liable to you or to?anyone else for loss or damages of any kind you experience relating to the ACECIS website as a result?of:

  • a) any errors, mistakes or outdated information on the ACECIS website or social media pages.
  • b) you acting out or failing to act out on information, content or directions found or referred to on?the ACECIS website, other websites linking to and from the ACECIS website or social media pages.
  • c) any personal injury or damage to personal belongings and property of any nature resulting from?accessing or using the ACECIS website or associated sites.
  • d) any breach of security or unauthorised access on the ACECIS website, servers and networks or?personal information and financial information stored on those servers and networks.
  • e) any disruptions, interferences or delays in accessing or using the ACECIS website.
  • f) any viruses, Trojans, bugs or harmful programs and code or communications which may be found?and transmitted through the ACECIS website or third part websites.
  • g) the quality and effectiveness of any product or service offered and delivered through the ACECIS?website or any third party sites.

4. Indemnity

4.1 You will at all times indemnify and keep indemnified all staff at ACECIS and associated presenters?including migration agents, human resources managers and professionals representing their?organisations against any loss (including legal costs) or liability you or we (ACECIS) incur from any?claim, legal proceeding, demand, suit or action by any person against you or ACECIS where the loss?or liability came from or was connected to your conduct or breach of this Agreement.

5. Becoming a member, coaching services and workshop bookings

5.1 You are responsible for all bookings and transactions in relation to becoming a member, booking?workshops or registering for any products or services. This includes responsibility for any errors in?your order caused by you.

5.2 We reserve the right to accept or reject your offer for any reason, including, without limitation,?the unavailability of any workshop, course, program, product or service, an error in price or the?product or service description posted on the ACECIS website or an error in your order.

5.3 There may be reasons why ACECIS cannot complete your registration for membership, coaching?or workshop booking/order. Therefore your contract with ACECIS begins when we advise you that?your order has been accepted and we have received payment in full.

5.4 The promotion of products and services on the ACECIS website does not constitute an offer?to sell. It is an invitation to treat only. Products and services on the ACECIS website may not be?available all the time and ACECIS takes no responsibility for this. We will however ensure that we?make our products and services available to you in a timely manner if they are unavailable at the?time.

5.5 Any orders placed by you are deemed as offers to purchase products and services which are?under the terms and conditions in the Agreement and offered at the price set out on the ACECIS?website.

5.6 Your transaction will be confirmed once you have completed the checkout process including the?processing of payment.

5.7 You will not be able to cancel or change your order once it has been confirmed and approved.?You must take care and review your order before completing the order process. If there are issues?with your order, you must follow the standard returns process (included in this Agreement). We will?generally not charge or replace your order if you have made an error.

5.8 If ACECIS is unable to complete your order we will provide you with a full refund.

6. Prices

6.1 All prices listed on the ACECIS website are in Australian dollars. Our prices are for membership,?workshops and coaching. The availability of our products and services may change from time to?time.

6.2 In order to receive your order in full, your payment must be approved and received. We are?unable to reserve your order until payment has been received.

7. Advertised dates

7.1 We reserve the right to change the dates for any workshop, session, product or service without?warning. In the event this happens, we will make all reasonable attempts to notify you. Confirmation?of the start time, venue and duration of the product or service remains your responsibility.

8. Products and services out of stock or fully booked

8.1 We reserve the right to advise you that products or services booked or ordered by you are?unavailable for reasons out of our control. You are entitled to a full refund if we are unable to fulfil?your booking.

9. Change of mind returns

9.1 We cannot refund, exchange or swap any products or services if you change your mind or if?you made an error in placing your order. We may however, entirely at our discretion allow a return?or refund on a case by case basis provided that the product or service refund, exchange or swap?request is brought to our attention within 28 days of being placed (order).

10. Termination of membership

10.1 Either party may terminate this Agreement by giving 28 days written notice to the other. If you?want to terminate your membership, you must do so in writing. Once your notice for termination?is received by ACECIS, your membership will be cancelled within 28 days. At such time, your access?to the ACECIS portal will cease. Automatic payments will stop 28 days after your written notice has?been received and accepted by ACECIS. In the event that your automatic payments do not stop,?please notify us immediately.

11. Process for returns

11.1 You must notify us via email if you seek to return a product or service. We will review your?request and advise you if it will be allowed.

11.2 If your request is granted, your refund will be issued using the same payment method used for?purchase. We will aim to process your refund within 28 days of the request.

12. Social media and content

12.1 You acknowledge and understand that all information, including images, text, messages,?comments, video, audio and other content that is posted, transmitted or linked from the ACECIS?website, its social media pages (LinkedIn, Facebook and Twitter) that publishes content from users?is the responsibility (sole) of the person that created and broadcasted that content. ACECIS takes?no responsibility for any content and material made available through the ACECIS website or social?media platforms/sites.

12.2 You may be exposed to content and material on the ACECIS website and related social media?platforms and sites that has originated, been created or developed by third parties that is offensive,?incorrect, inaccurate and misleading. You understand and acknowledge this and use the ACECIS?website and its associated sites and linked sites at your own risk. We do not accept any liability for?any offence, suffering or insult caused to you as a result of using the ACECIS website and associated?pages.

13. Use of social media and forum

13.1 If you use the ACECIS forum and/or ACECIS social media platforms (Facebook, Twitter and?LinkedIn), you are responsible for any content submitted, posted or exchanged through these?channels. You must not post or allow content that:

  • you do not have the right to post
  • is defamatory, offensive or is in contempt of any legal or other proceeding
  • is misleading or deceptive
  • is offensive, discriminatory and prejudice against a person or group of people defined by?their race, religion, colour, origin, nationality, ethnicity, sexual preference, gender or beliefs
  • is obscene, vulgar, pornographic, untrue or indecent
  • violates or infringes copyright, trademark, patent of other intellectual property right of?another person or people
  • contains unauthorised advertising or promotional material
  • has links to or associations with any viruses, software or programs that have the potential to?harm computers, networks, databases and servers
  • attempts to or claims to misrepresent your or ACECIS’ relationship with another person or?people

13.2 ACECIS reserves the right to preview and screen, refuse or remove any content from the ACECIS?website, social media or related pages at any time without giving any reason.

13.3 You also understand and agree that we may retain copies of your submitted content and?material on databases and servers.

14. Intellectual property (IP)

14.1 ACECIS reserves all IP rights including copyright material, resources, products and services and?information provided by us. Nothing in this Agreement gives you a right to use any of our material,?collateral, products or services, logos, trademarks, domain names or brand features.

14.2 You are not permitted to copy or change the layout or appearance of the ACECIS website using?any software code or material contained in the website or attempt to discover, access or change any?source code related to the ACECIS website.

14.3 If you communicate or correspond with us, you automatically give us the non-exclusive, royalty?free, perpetual, irrevocable, fully sub-licensable right to use, reproduce, adapt, publish, translate,?create other works from, copy, display and distribute the content of your communication and?or correspondence. We may use this material in testimonials on the ACECIS website and other?promotional material.

15. General

15.1 You understand and acknowledge that ACECIS is not liable for any delay in performing any of?our obligations outlined in this agreement.

15.2 This agreement will be governed and interpreted by the laws of Victoria, Australia. You?irrevocably submit to the exclusive jurisdiction of the course of the State of Victoria, Australia.

16. Privacy

16.1 If you submit or provide ACECIS with any personal information, the ACECIS privacy policy will?use or disclose that information. For more information please see our privacy policy.
